    1. Each Participant is hereby informed that for the purpose of participation in the Survey each Participant will be required to provide the following information

    1. The information categorized as “Mandatory” above is to be mandatorily to be provided by each Participant for participating in the Survey. This information is required to ensure compliance with the applicable laws in India and for participation in the Survey. 
  1. Purpose
    1. The above-mentioned information will be used for the following purposes
    1. To record your information and your response as a part of the Survey,
    2. To ensure compliance with the laws of India;
    3. To periodically send you OTPs or Verification code, offers and other marketing communications related to product offers, launches, advertisements, schemes, etc;
    4. To send you push notifications related to the Survey; and
    5. For such other purposes as will be notified to you from time to time.
  1. Consent
    1. Each Participant hereby consents for sharing the above mentioned with the Survey Agency and to Castrol, each for using such information for the Purposes set out above.
    1. It is understood that Castrol may from time to time appoint third party service providers or may receive services from its affiliates for fulfilling the purposes set forth above, and for the said purpose a Participant’s information may have to be shared with such third parties and affiliates.
    1. In order to provide its products and services Castrol may need to share your personal information with other companies within the Castrol and bp group of companies, and/or third-party service providers that process data on our behalf. Since Castrol operates globally, Castrol may share the information in other jurisdictions or want to transfer your personal information to other countries, including countries outside India.
    1. Castrol also reserves the right to disclose a Participant’s personal information as required by law, or when Castrol believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, request from a regulator or any other legal process served on Castrol.  If Castrol is subject to a takeover, divestment or acquisition we may disclose your personal information to the new owner of the business.     
    1. Each Participant is required to ensure the correctness of the information updated and is required to keep all the information corrected from time to time. Castrol will not be responsible for any loss, damage or other liability arising out of incorrect or incomplete information updated by a Participant.
  1. Manner of Use
    1. Castrol shall use the aforementioned information as per its Privacy Policy available at  https://www.castrol.com/en_in/india/home/privacy-statement.html.
    1. Castrol may also share your information within the bp group, for furthering its offerings, understanding markets better and to do analytics & research.
  1. Consent Withdrawal
  2. In case a Participant does not wish to receive calls, emails or messages from Castrol, or do not consent to Castrol affiliates using or retaining his/her information, the participant can email a request to customercare.india@castrol.com

  2. I agree to participate in the survey being conducted by a service provider appointed by Castrol India Limited (“Castrol”). I hereby share my name and personal details willfully after having understood the intended use of such information. I agree and consent to collection, sharing, using (including with third parties for implementing brand activation activities, campaigns, marketing communication, and for other offers/activities in future) storing, & processing of this information i.e., name, address, phone number, email id, etc, for the purposes detailed herein, as per Castrol’s privacy policy available at https://www.castrol.com/en_in/india/home/privacy-statement.html.

    Castrol may share the information within the BP group companies, and/or with other third-party service provides including data processors from or outside India. Castrol also has the right to use and publicize my name, picture, video and/or voice etc, of any participant for other activities, in any manner and medium (including internet) as deemed fit. Castrol shall own the IPR on such videos, pictures, and other material. I agree that Castrol and/or its appointed service provider shall be permitted to use the information I shared for training, promotions, and marketing purposes in present or future, for activities that Castrol has undertaken or may undertake in future.

    I also understand and agree that
    (a) these details will be held and retained by Castrol and BP group companies as a part of their records and will be used by Castrol and BP group companies as and when they deem fit;
    (b) Castrol can share brand related content (audio-visuals, images, files etc.) from time to time on my phone via SMS or through social media including WhatsApp, facebook, Twitter, Instagram, and I have no objection to the same. I waive my rights for any royalty/remuneration for such use,
    (c) all personal details and information provided to Castrol are true and correct.

    Any disputes between you and Castrol shall be subjected solely to the jurisdiction of courts in Mumbai.

Survey Terms and Conditions

  1. Castrol India Limited, (“Castrol”), has conceptualized, designed, planned, organized, paid for and will be running the survey titled as Castrol CRB PLUS Survey, (“Survey”).
  1. Castrol shall be the organizer of the Survey and 4 MINUTE MILE MARKETING SERVICES PRIVATE LIMITED (“Survey Agency”) shall be its operator across India.
  1. The Survey will be operated in line with the terms and conditions set out and/or referred to herein under.
  1. Survey Outline: The primary objective of the Survey is to collect data the aforementioned data through a microsite to understand the reach, sales and consumption of Castrol products in various markets across India and provide the Participants information of relevant Castrol offerings of products, offers, and other marketing initiatives.
  1. Survey Operation: This Survey will be conducted by the Survey Agency.  
  1. Participants: Any consumer who confirms to the eligibility criteria laid out herein under and  who registers itself as a participant through various online and offline modes of registration which modes include and shall not be limited to a) registers on the website provided for Survey registration, b) provides its details to the Survey representatives promoting the Survey across markets in India, c) or registers in such other modes as the Survey communications provide for shall be considered as a participant (“Participant”) of the Survey. Please read the Privacy Notice for participation in the Survey, as set out below.
  1. Applicability of these Terms: These Terms and Conditions (“Terms”) apply to all the Participants.
  1. Acceptance of Terms:
    1. By participating in the Survey, providing the OTP for confirmation of participation, and accessing the associated website, each Participant agrees to comply with and be bound by these Terms.
    1. Any Participants who does not agree with any part of these Terms, may not participate in the Survey.
    1. Participants agree and acknowledge that the Survey benefits may not be available across the country and only Participants who are available in person at the location notified on the notified date and time may be able to physically receive the Survey benefits.
    1. Participants may receive the said benefits by such other medium as may be defined and notified by Castrol or Survey Agency. Each Participant agrees and acknowledges that the Survey benefits are exclusive to the Participant and shall not be transferred to any third party.
  1. Eligibility:
    1. To participate in the Survey, a Participant must be a farmer and/or Castrol consumer.
    1. Each Participant represents each of the following to Castrol and the Survey Agency
      1. He/she is at least 18 years of age (or (if different) or at least the age of legal majority in your country of residence) and is fully able and competent to enter into these Terms, and abide by and comply with these Terms;
      2. all information provided by him/her for participation (including during registration) is true, accurate and up to date in all respects and at all times;
      3. He/she will comply with these Terms;
      4. He/she is a citizen of India and holds a valid proof of citizenship;
      5. He/she has valid driving license in India to drive tractors / heavy vehicles;
      6. He/she is willing to submit all valid documents and provide its copies for verification at any time when called for;
      7. He/she Is not barred under any law, order, regulations, rules or judgements or otherwise from entering into contracts;
      8. He/she is operating and residing in compliance with the laws of India.
    1. By registering for the Survey, each Participant confirms that it meets the eligibility requirements.
  1. Entire Agreement:
    1. These Terms constitute a legally binding agreement between a Participant, Castrol and Survey Agency and these terms shall govern every individuals participation in the Survey and its access to the information, offers, services, features, content offered along with other benefits set out in the Survey.
    1. These terms may be updated by Castrol and/or the Company from time to time with or without any prior notice to any Participant. Each Participant is required to keep itself updated with the Survey and the participation terms and conditions from time to time by visiting (www.castrolagriactivation.com). Each Participant shall be deemed to have read and agreed to all the amendments that are made to these Terms from time to time. 
    1. Participation in the Survey is subject to the Participant’s continued compliance and subject to these Terms. In addition, when using any particular services, benefits or offerings which form part of the Survey, a Participant may be required to agree to additional terms, guidelines or rules as may be applicable for receiving such offerings and benefits. All such additional terms and guidelines or rules shall hereby stand and deemed to be incorporated by reference into these Terms.
  1. Registration: To access the resources, offerings and updates related to the Survey, Participants must register for the Survey in the manner notified. During the registration process, Participants will be required to provide personally identifiable information such as name, mobile number, state etc. and each such information provided by the Participant shall be accurate, updated and complete information.
  1. Intellectual Property: All content as part of the Survey, is the intellectual property of Castrol India Limited. Participants agree not to reproduce, distribute, or use such materials for any commercial purposes without the express written consent of Castrol. All such material shall be provided on good faith basis and shall not be construed in any manner as an financial, legal, regulatory, health or other advise from Castrol or Survey Agency. All such information has been developed in consultation with certain third-party service providers and is provided on as is basis. All such material shall only be utilized by the Participant as a reference material. All Participants are required to following discretion before following any advise provided during the Survey. Each Participant is required to receive expert advise on all the aspects before taking any actions. The Participants along shall be responsible for their acts or omissions made pursuant to this Survey.
  1. External Links: The Survey website may contain links to third-party websites. The Company is not responsible for the content or accuracy of external sites and does not endorse or guarantee their services. Each Participant agrees to read and understand the terms of use, privacy policy and other applicable terms for usage of such website and agrees to comply with each of such terms and conditions. 
  1. Privacy Policy: Participants' personal information collected during registration will be handled in accordance with the Privacy Policy https://www.castrol.com/en_in/india/home/privacy-statement.html. Each Participant is required to read through and understand such privacy policy before registering under the Survey. All terms and conditions set out in the Privacy Policy shall stand included by reference under these Terms.
  1. Modification of Terms: Castrol reserves the right to modify, suspend, or terminate the Survey or these Terms at any time. Participants are responsible for reviewing the Terms periodically for changes.
  1. Governing Law: These Terms are governed by the laws of  India. Any disputes arising under these terms shall be resolved subject to the exclusive jurisdiction of courts in Mumbai. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, Participant’s rights and obligations, or the rights and obligations of Castrol in connection with the Survey, shall be governed by, and construed in accordance with laws of India without giving effect to any choice of law or conflict of law rules.
  1. Limited Liability: Each Participant agrees that in no event shall Castrol and/or its affiliates, and their respective officers, directors, agents, and employees, be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of or related to this Survey.
  1. Participant’s agrees to provide Castrol testimonials of their experience of their participation in this Survey or general testimonials on Castrol. The Participants also agree to sign and provide to Castrol a release form such testimonials, which release form shall assign the testimonials to Castrol and permit Castrol ’s use of  the same in line with such release form.
  1. Castrol reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Survey with or without prior notice at any time for whatsoever reason, including but not limited to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud, injury, safety issues etc ). The decision of Castrol in all matters under its control relating to the Survey is final and binding and no correspondence will be entertained related to the same.
  1. Castrol or Survey Agency shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, epidemic, pandemic, hostilities, political unrest, riots, civil commotion, inevitable accidents, acts of God or any other circumstances amounting to force majeure (including the operation/disruption of the internet/telephone systems) and Castrol may cancel all or any part of the Survey without any liability to any person whatsoever.
  1. Castrol and its affiliates and subsidiaries, and all respective officers, directors, employees, representatives, and agents of each, shall have no liability and shall be held harmless by the Participant for any damage, loss, or liability, cause of action, claims, suits, demands and rights of whatever kind and nature whether in law or in equity, arising out of or in connection with the Survey.
  1. Castrol shall not be responsible for a) technical, hardware, software or other failures of any kind; or b) for any lost, interrupted or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by Castrol, Participant, or by any of the software, application, equipment or programming associated with or utilized in the Survey; or c) any technical or human error which may occur in the processing of data which may damage a Participant’s system or limit a Participant’s ability to participate in the Survey.
  1. Castrol shall also not be responsible for any loss or damage if it must discontinue or cancel the Survey in compliance with any law, ruling, order, regulation, requirement or instruction of any central/state government or for any other unavoidable reasons beyond its control.
  1. Castrol will not be responsible in case any of the terms of the Survey are misunderstood or misconstrued by the Participant.
  1. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between Participants and Castrol.
  1. Each Participant agrees that participation in the Survey is voluntary and has been done by a Participant out of its own will, after reading and understanding these Terms and after taking appropriate legal advise wherever required.
  1. Castrol shall not be obligated to ascertain a Participant’s compliance with these Terms and each Participant declares his/her compliance with these Terms.
